Supreme Court Vacates ‘Status Quo Ante Bellum’ Order in ADC Leadership Dispute


The Supreme Court of Nigeria has set aside the controversial “status quo ante bellum” order issued by the Court of Appeal in the ongoing leadership crisis within the African Democratic Congress (ADC), marking a significant turn in the protracted legal battle.
In its judgment delivered on Thursday, the apex court held that the order directing parties to maintain the pre-dispute condition was unnecessary, improper, and legally unwarranted. The court noted that such an order should not have been granted in the circumstances surrounding the dispute, as it risked prejudging substantive issues yet to be fully determined.


The ruling effectively nullifies the earlier directive of the Court of Appeal, which had attempted to preserve the leadership structure that existed before the litigation. By vacating the order, the Supreme Court has cleared procedural obstacles that had complicated the resolution of the internal party crisis.


The court further directed that the matter be remitted to the Federal High Court for proper hearing and determination on its merits. This means that the substantive issues concerning the leadership of the party will now be fully examined at the trial court level.
Legal observers say the judgment reinforces the principle that courts must exercise caution in granting interim or preservative orders that could influence the outcome of a case before hearing all parties. The decision is also seen as a reaffirmation of procedural fairness and judicial discipline in politically sensitive disputes.


The ADC has been embroiled in a leadership tussle that led to multiple court actions, with different factions laying claim to the party’s national leadership. The now-vacated order had been a key point of contention, as it temporarily recognized a particular leadership arrangement pending final resolution.


With the Supreme Court’s intervention, attention now shifts back to the Federal High Court, where the core issues of legitimacy, party structure, and leadership authority are expected to be determined.


The ruling is likely to have immediate political implications within the party, as stakeholders reassess their positions ahead of further legal proceedings.
